These Terms of Service ("Terms") govern your use of the Qmoon platform at qmoon.in and all related services. By creating an account or using our services, you agree to these Terms.

1. About Qmoon

Qmoon is a programmatic DOOH (Digital Out-of-Home) advertising platform that connects advertisers with physical display screens across India. Screen owners earn revenue by displaying ads, and advertisers reach real audiences in physical locations.

2. Eligibility

You must be at least 18 years old to use our services.
You must provide accurate and truthful information during registration.
You are responsible for maintaining the security of your account credentials.

3. User Accounts

A single account can act as both an advertiser and a screen owner.
You may not share your account or credentials with others.
You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Advertiser Terms

You are responsible for ensuring your ad content is lawful and does not infringe on any third-party rights.
Ads must not contain misleading, deceptive, or fraudulent content.
All ad content is subject to review and approval by our moderation team.
We reserve the right to reject or remove any ad content that violates our policies.
Campaign budgets are charged per verified play. Unspent budget is refunded as credit-back.
Play confirmations are recorded by the screen player device and verified server-side.

5. Screen Owner Terms

Screens must be registered and approved before they can serve ads.
Screen owners earn 70% of the ad revenue from each verified play on their screen.
Earnings can be withdrawn via UPI with a minimum payout of ₹100.
Screens must remain online and operational. Screens offline for extended periods may be deactivated.
You must not tamper with, manipulate, or artificially inflate play counts.
Reserved screen time for private/self-promotion campaigns is limited to 50% of the display cycle.

6. Content Guidelines

The following content is prohibited on the platform:

Illegal, harmful, or threatening content
Content that promotes discrimination, hatred, or violence
Sexually explicit or pornographic material
Content that infringes copyrights, trademarks, or other intellectual property
False, misleading, or deceptive advertising
Content promoting tobacco, alcohol (where restricted), or controlled substances

7. Payments and Financial Terms

All financial transactions on the platform are recorded in our double-entry ledger system.
The platform commission is 30% of each ad play revenue.
Campaign pricing is based on the CPM tier and creative duration.
All amounts are in Indian Rupees (₹).
Tax compliance (GST, TDS) is the responsibility of the respective user.

8. Intellectual Property

The Qmoon platform, brand, logo, and software are our intellectual property.
You retain ownership of the content you upload (ad creatives, venue photos).
By uploading content, you grant us a license to display it on screens as part of the ad delivery service.

9. Limitation of Liability

Qmoon is provided "as is" without warranties of any kind.
We are not liable for screen downtime, network issues, or delivery delays beyond our control.
Our total liability is limited to the amount you paid to the platform in the preceding 12 months.

10. Account Termination

You may delete your account at any time from your profile settings or by emailing privacy@qmoon.in.
We may suspend or terminate accounts for violations of these Terms.
Upon termination, outstanding earnings will be paid out per our payout schedule.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
